I love my neighborhood, and only have one problem, the children that live in the house behind mine. I have a fenced in yard, so do the neighbors, in between our fences is an easement with a couple trees. The children from behind me, like to climb the trees, the ages of the children (guessing are 4-7), there is never supervision, so these kids do what they want. My problem is that they throw trash in my yard, and sticks at my dogs (little dogs). I really don't like my dogs being abused, they cannot attack the kids, nor would I let them, they won't even bite if someone comes in my yard. My husband says that next time they are out there, doing any of the things, we need to call the police on the kids. Last year, my hubby tried talking to the dad, but he won't even look at him when he says "excuse me" or anything else. Any ideas?

Hate to say it but hubby is correct unless someone on APD would like to weigh in on the subject. Let APD talk to the parents.

I wanted to have my son and nephew act like bullies and intimidate those brats! LOL! I guess I would not do that in reality, sounds good.
Last summer my hubby wanted to borrow a friends Pit Bull, but we were afraid that Bubba would hurt the kids. Last summer they used to hang on the limbs that go into our yard. Called the city about getting them cut down, they did cut off a bunch, but not down, the trees are in the easement, not my responsibility, or at least I don't think so. My question was that if the brats fall off of those branches that hang into my yard and break an arm, is it my responsibility?
Shouldn't be, but if there in a city easement, you could remove those branches and I'm sure they wouldn't say a word.

In my state, any branches from adjoining property that hang onto your property is your responsibility, including the spoils, ie; fruit. In other words, cut them down.
Also, since it is easement, and the way you are talking ~ city property ~ I would think you would have rights of presentation. Cut the trees down!

No you probably have to call the police on that one, especially if the father is not cooperating. Have you tried telling the kids to get out of the trees?
Since the parents aren't responsive, I would call APD and make a police report about the nuisance. The report should include your opinion that the tree should be removed for the children's safety, to prevent future problems. Perhaps they will talk to the children's parents. Regardless, get a copy of the police report.
Get your parcel number off your tax document or assessment. Call the Auditor's office and ask for Sue Barth. Give her your parcel number and tell her you want to know who has the legal responsibility for trees on the easement behind your house. She should be able to tell you. If you need to follow it up with a person, or with the City of Anderson, she should be able to give you contact information.
If you are told the responsibility is yours, make sure you write down who told you this and when. Add that to the police report. Get quotes and go ahead if it seems reasonable. Trees are expensive to remove if they're mature.
If the responsibility is not yours, then follow up with the City or the property owner, making sure you document your calls with names, dates and times or better yet, make copies of any letters/emails you send. You may have to make a nuisance of yourself to have it taken care of, but it's better than a lawsuit.

Why am I thinking she would be better suited to call MCSD...and ... is it city property or is it county property? I seem to think that she might be living where she couldn't vote for the Mayor....like another one of our posters. My daughter leaves out in that area...(meaning her kids go to Valley Grove) and they also have that same type of easement behind their house. I know that any trouble that happens out in that neighborhood, is referred over to the county cops.
