Considering a lot of his actions with the little man syndrome when he was mayor. I do not know why this action would surprise anyone.  Is he so silly that he thinks if he won the lawsuit that the people would re-elect him??

A quarter of the way


A quarter of the way through the first year of the next term, it doesn't make sense for Smith and company to pursue this case.  For the sake of Anderson, it should have been done BEFORE the election if it were truly an issue, or immediately thereafter.  Five months after the election, it would be very disruptive for Mr. Ockomon to be removed from office, especially because it would leave the city leaderless. Kevin Smith cannot reprise a mayoral role he has effectively abandoned, and there is no deputy mayor that I know of.

If the case is pursued, then it costs the City money in legal fees and in economic development. If the case is pursued and won, it will cost the city money to hold a new election because Kevin Smith will NOT be reappointed as mayor, temporary or not.  And it's quite likely that Smith would lose a very divisive election, were it held on the heels of his lawsuit. So what is the point, at this late date? It's a lose/lose/lose situation for Smith and Company to continue the lawsuit.
